Motion for Exclusion of Evidence and Acquittal (possession of prohibited weapon)
Mrs. Anne-Marie Langlais and Mr. Nicholas St-Jacques were in charge of the file. The judge of the Court of Quebec ordered the exclusion of brass knuckles from the evidence, as it was obtained in violation of section 9 of the Charter. The police officer did not have reasonable grounds for suspicion to justify detaining the evidence for investigation. His version of events was contradicted by a 911 call and by the radio conversations between police officers.
