Charter motion granted, followed by acquittal

In a file concerning impaired driving, the Court granted a Charter motion based on the right to counsel. The police officers had imposed their choice of lawyer on the accused, despite the accused having asked specifically for a different lawyer. The Court concluded that the police officers had violated the right of the accused to consult the lawyer of his choice. The accused was later acquitted. The file was led by Mrs. Rachel Payeur.
